Crna Gora je uknjižila još jedan minus u međunarodnim izvještajima. Uticajna američka organizacija Fridom haus ocijenila je, u redovnoj godišnjoj publikaciji Države u tranziciji, da je pravosuđe u Crnoj Gori nazadovalo i zbog toga što sudije izriču visoke kazne medijima. Analizirane su bivše zemlje SSSR-a, deset novih članica EU i zemlje Balkana. Ta organizacija podsjeća da je u prošloj godini ostalo nekoliko neriješenih slučajeva nasilja nad novinarima, a da su sudovi protiv medija izricali visoke novčane kazne po tužbama za klevetu. Bez promjene zvaničnih stavova prema nasilju nad novinarima ili kleveti, uz opasnost da bi zakonodavne promjene mogle omogućiti vraćanje kontrole vlasti nad medijima, rejting Crne Gore za nezavisne medije ostaje na prošlogodišnjem 3,75 - zaključuje Fridom haus. Istraživači Fridom hausa registrovali su i da je ,,nezavisna agencija za radio-difuziju pripojena novoj agenciji koju kontroliše vlast, ugrožavajući izglede za nezavisnu raspodjelu frekvencija".
Predsjednica Vrhovnog suda Crne Gore Vesna Medenica ocijenila je da je Fridom haus koristio netačne podatke za svoj izvještaj i da ne može komentarisati sudske odluke o visokim kaznama protiv novinara.
Stanje na terenu potvrđuje - teško nezavisnim medijima kad dopanu u ruke sudske vlasti.
Jedan od dokaza: ukoliko sudovi usvoje sve tužbe, nedjeljnik Monitor i dnevnici Vijesti i Dan platiće oko 13 miliona eura kazni za klevete i duševne bolove. Ne računajući već isplaćene kazne, Monitor je, na primjer, za duševne bolove trenutno ,,dužan" oko 300 hiljada eura, dnevnik Vijesti oko 12 miliona, a Dan između 200 i 300 hiljada eura. I to sve - U ime naroda.
Indikativno je da su većinu tužbi protiv navedenih medija podnijeli ljudi bliski premijeru Milu Đukanoviću, koji je svojevremeno tužio dnevnik Vijesti i tražio odštetu od milion eura. Taj iznos postao je reper mnogim sudijama prilikom odmjeravanja astronomskih kazni po kasnije podnesenim tužbama protiv nezavisnih medija.
Cilj visokih kazni je jasan - ekonomski uništiti i ugasiti nezavisne medije i zastrašiti novinare da slučajno i ne pomisle da objave nešto što nije po volji političkih moćnika. Ako im nešto nije jasno - neka se ugledaju na Pobjedu i Javni servis. Oni su zaduženi za proizvodnju ljepše stvarnosti.
Zbog toga je sudbina crnogorskih medija najgora u regionu. Nema nikakvih šansi da naša vlada učini oni što je učinjeno u Srbiji - da i nezavisnim medijima pruži finansijsku podršku. Ideal ovdašnjih vlasti je da u javnosti odliježe samo eho njihovog vlastitog glasa.

SAVJET NOVINARSKOG SAMOREGULATORNOG TIJELA APELOVAO DA SE IZMIJENI KAZNENA POLITIKA ZA KLEVETU I UVREDU Drakonske kazne za slobodne medije ~Trenutni odštetni zahtjevi protiv "Dana", "Vijesti" i "Monitora" pred crnogorskim sudovima iznose više od deset miliona, dok su izreèene kazne prešle više stotina hiljada eura Savjet Novinarskog samoregulatornog tijela apelovao je na nadležne institucije da što prije izmijene regulativu i kaznenu politiku za klevetu i uvredu u medijima. Apel je upuæen predsjedniku Skupštine, ministrima pravde i kulture sporta i medija, ombudsmanu, kao i predsjednicima Vrhovnog i Ustavnog suda, saopšteno je na konferenciji za novinare Savjeta NST-a. - Uvjereni da Crna Gora treba da ide putem izgradnje demokratskog, slobodnog i graðanskog društva po meðunarodnim principima i standardima, pozivamo vas da što prije pokrenete struènu raspravu i procesne radnje za preispitivanje i izmjene odredbi i prakse po kojoj su za klevetu i uvredu medijima i novinarima presuðene visoke novèane kazne - navodi se u apelu. U NST-u smatraju da bi javna upozorenja tog tijela da su visoke novèane kazne u disproporciji sa generalnom kaznenom politikom i u suprotnosti sa demokratskim razvojem medijskih sloboda, nadležni trebalo da prihvate kao "glas profesionalaca koji kontinuirano insistiraju na samoregulaciji". - Prioriteti izmjena treba da budu usklaðivanje sudske sa praksom Evropskog suda, eliminisanje prakse po kojoj nesrazmjerno visoke novèane nadoknade za uvredu i klevetu dugoroèno imaju negativan efekat na slobodu izražavanja i medije i ustanovljenje balansiranih modela za medijsko izvinjenje, objavljivanjem presude, ispravke i tome slièno. Sve to podrazumijeva i raspravu o dekriminalizaciji klevete, jer iskustvo zemalja gdje se zakoni o kriviènoj kleveti ne koriste pokazuje da se ugled može adekvatno zaštiti graðanskim zakonom i razvojem medijske samoregulacije - navodi se u apelu. Savjet je pozvao ombudsmana da, poštujuæi Zakon o zaštitniku ljudskih prava i sloboda, zatraži usklaðivanje propisa sa meðunarodnom praksom. - NST dijeli mišljenje Savjeta Evrope, OEBS-a i Fridom hausa, kao i drugih releventnih meðunarodnih institucija, da visoki odštetni zahtjevi i kazne ugrožavaju slobodu govora, koja je garantovana Ustavom Crne Gore i drugim pozitivnim nacionalnim i meðunarodnim propisima. Podsjeæamo da crnogorski Zakon o medijima obezbjeðuje i jamèi slobodu informisanja na nivou standarda sadržanih u meðunarodnim dokumentima o ljudskim pravima i slobodama, i da ga treba tumaèiti i primjenjivati u skladu sa principima Evropske konvencije za zaštitu ljudskih prava i osnovnih sloboda, uz korišæenje prakse Evropskog suda za ljudska prava. I Evropski sud za ljudska prava generalno smatra da kažnjavanje novinara zbog prenošenja izjava drugog lica predstavlja kršenje slobode izražavanja. Zbog prenošenja izjava drugog lica više puta kažnjene su dnevne novine "Dan" i "Vijesti" i nedjeljnik "Monitor", iako Evropski sud za ljudska prava istièe da to "ozbiljno ugrožava doprinos medija diskusiji o pitanjima od javnog znaèaja i ne smije se primjenjivati, osim u sluèaju izrazito snažnih razloga. Iz presuda tog suda jasno proizlazi da kritika politike i politièara predstavlja suštinu demokratskog društva i da pravo na slobodu govora i izražavanja uživa punu zaštitu Evropskog suda za zaštitu ljudskih prava u Strazburu - navodi se u apelu. Savjet NST podsjeæa da trenutni odštetni zahtjevi protiv "Dana", "Vijesti" i "Monitora" pred crnogorskim sudovima iznose više od deset miliona, dok su izreèene kazne prešle više stotina hiljada eura. - Ocjenjujemo da to ugrožava slobodu medija i javnu debatu u Crnoj Gori o najvažnijim društvenim pitanjima. Ovako visoki odštetni zahtjevi i kazne mogli bi da ugroze ekonomsku održivost medija - navodi se u apelu NST-a. M.V.R.-D.Ž.
Preispitati presude NST smatra da ima dovoljno osnova i za pokretanja rasprave pred nadležnim pravosudnim organima za preispitivanje zakonitosti odluka više crnogorskih sudova, kojim se štampani mediji "Dan", "Vijesti" i "Monitor" kažnjavaju neprimjereno visokim novèanim kaznama na ime duševnih bolova za klevetu. - U skladu sa navedenim, oèekujemo da brzo reagujete i uèinite sve kako bi, slijedeæi evropsku praksu, ojaèali zaštitu slobode govora i izražavanja, koje jamèi Ustav Crne Gore - zakljuèuje se u apelu. NST je pozvao i sve aktere medijske scene u Crnoj Gori da, pokretanjem struènih rasprava i sopstvenim primjerom poštovanja etièkih principa, podrže njihov apel.
