The European Court of Human Rights ruled yesterday that Turkey violated the right to life in the case opened by families of two Greek Cypriots killed in violent events in August 1996, which were sparked by a series of protests.
The court agreed that Anastasios Isaak, who participated in a Greek Cypriot demonstration to protest against the Turkish presence in the northern part of Cyprus on Aug. 11, 1996, was beaten by Turkish counter-protestors and some members of the northern Cypriot police. The court further noted that Solomos Solomou, who attended Isaak's funeral on Aug. 14, 1996, entered the buffer zone with other demonstrators near the spot of the killing and, in protest, climbed a flag pole flying the Turkish flag. He was shot dead while trying to reach the flag.
The court underlined that a medical report concluded the cause of Isaak's death as 'multiple head trauma.' "Solomou had been hit by five bullets, what is a fact hard to reconcile with the (Turkish side's) theory that his shooting had not been intentional,” according to the report.
The court awarded 80,000 euros to Anastasios Isaak's widow for pecuniary damage, and $35,000 each to Anastasios Isaak's widow, his parents, and to Solomos Solomou's father for non-pecuniary damage. The court also ruled for 15,000 euros of payment to each of Anastasios Isaak's and Solomos Solomou's siblings. The applicants in both cases were also awarded 12,000 euros for costs and expenses.
