Italian Court Rejects Montenegro Plea
24 December 2007 Podgorica _ An Italian Court of Appeal extended the custody of Montenegrin senior officer, Ilija Brcic, on Monday, despite assurances from Montenegro's government that he can be transferred to Podgorica.
'The Court does not see the guarantees of the Montenegrin government as secure and reliable enough', Luiggi Lanucara, the lawyer for Brcic told the Podgorica-based daily Dan.
Brcic, who is the Chief of the Montenegrin General Staff’s Department for Development, was detained at Rome airport on November 6 on a Croatian warrant, accusing him of crimes against humanity committed during the 1991-95 war.
Matija Nikolic, a spokesman for Montenegro's opposition Democratic Serb Party, DSS, said the attitude of the Italian judiciary 'is a slap to Montenegrin authorities..'
Brcic, was the captain of a Yugoslav navy ship during Croatia's war of independence from Yugoslavia when the alleged offences were committed. He was originally charged in 1992, and a year later sentenced in absentia to 15 years in prison for crimes against humanity, by a court in the Croatian city of Split.
