‘Delta’ claims to have not received yet the decision by the Competition Commission by which merging of ‘C Market’ is denied. The company shall make its stance public only after receipt and thorough study of the decision.
The decision by the Competition Commission is based on the fact that by takeover of ‘C Market’ the ‘Delta’ company has taken the dominant position in Belgrade in view of the number of shops (market share over 50 per cent). The law on competition protection allows maximal 40 per cent concentration. It is interesting that ‘Delta’ took over ‘C Market’ without previously getting approval by the Competition Commission. It is even more interesting that ‘Delta’ has not even asked such approval. Thus the Commission launched the procedure with the Supreme Court for decision over the legality of the takeover. ‘Delta’ complained of the first court decision and the court then cancelled the Commission’s decision and returned the subject for new proceeding. The Commission now made new decision with the same conclusion. As lawyers say this second decision could be also annulled since when ‘Delta’ was taking ‘C Market’ over, the actual anti-monopoly law was still not in force.
