Foreigners Will Not Be Able to Buy Everything

Government Adopts an Improved Version on the Ownership and Legal Rights. New legislative foresees that foreign citizens cannot be owners over “natural resources and public goods, agricultural land, forests and forest land, cultural monuments of extreme importance, real-estate in areas which have been proclaimed as areas which cannot be owned by foreigners due to the protection of country’s interest and security…” Minister Nenezic also announces valorization of state-owned property on Lustica Peninsula.
Podgorica – Government has adopted a draft Law on the Ownership and Legal Rights, which introduces certain restrictions for foreign citizens.
“Foreign citizens would, eventually, be allowed to obtain the ownership of a total of five percent of Montenegrin territory, assuming that we were all to move out and sell our property to the foreigners, which-in practice-is not possible”, Minister of Finance, Igor Luksic said during the government’s session.
New legislative foresees that foreign citizens cannot be owners over “natural resources and public goods, agricultural land, forests and forest land, cultural monuments of extreme importance, real-estate in areas which have been proclaimed as areas which cannot be owned by foreigners due to the protection of country’s interest and security…”
“However, foreigners can have the right to a long-term lease, right to achieve bot-arangements over real-estate or have a concessions for up to 30 years, with the possible prolongation, if such move gets previous clearance”, Luksic stated.
In order to “preserve certain form of individual requests”, government as proposed that certain mountain areas would be available for foreigners who are interested in ownership rights over agricultural or forest-land up to five thousand square meters, if the redemption at stake is an object whose aim is to be used for living purposes.
“We find that we should not dissimulate the trade with holiday houses and houses in these areas by completely excluding the foreign citizens. Increased tendency to build will have to be cleared through the process of spatial planning”, Luksic has explained, adding that an example of such area are mountain areas at municipalities of Zabljak, Rozaje and Kolasin.
Minister said he expected that the Parliament would ratify this law with a two-third majority, as the new solutions should not be perceived as controversial, rather as ones that would give boost to the new investments and allow Montenegro to become an attractive destination for continued investments in the field of tourism and real-estate.
“These solutions would also meet our primary interest, which is the rational use of space as our primary resource. Solutions are in line with the Treaty on Accession and Stabilization with the EU and are not discriminatory”, Luksic has emphasized.
Ministry of Finance has developed the draft of this law several months ago, which went through a public discussion and returned for improvements. This, following protests introduced by Social Democrats, who objected the concept of property selling to foreign citizens without any restrictions.
At yesterday’s session, government has also agreed to give concessions for the explorations to be done at certain rivers, as well as the building of small power-plants at seven locations.
“Rivers at stage are Bjelasnica, Crnja, Bistrica, Sekularska,Grlja, Zaslapnica and Babinopoljska. The job had be given to “Energy Zoltar” from Austria, “Kroling and Dekart” from Podgorica, Niksic-based “Bast”, “Hidroenergija Montenegro” from Berane and “Hajder Extreme Energy” from Sarajevo.
Contracts will be signed with these companies, while the tender-procedure for the other rivers would be opened soon”, Minister for Economic Development, Branimir Gvozdenovic has said, adding that “the first realizations” with small hydro-power plants are to be expected in two years’ time.
Minister said that the government had formed the team of experts to valorize Moraca river and that the tender for the realization of this endeavor would be opened by the end of the year.
Draft laws on Geographic Origin Marks, the European Charter on Local Authorities and Cultures, etc. have also been accepted during this session.
Government has also adopted Information on how the damage inflicted during last year’s floods, which hit five municipalities in northern Montenegro, had been dealt with. Estimated damage comes up to Euro 1,2 Million.
A Tourist ‘Boom’ Expected at Lustica
Government has also adopted a decision to valorize the part of state-owned property on Lustica Peninsula, at which the project similar to that of Porto Montenegro would be developed.
“Government will valorize six million square meters of land which is in its’ property and 3,5 million which is owned by local authorities. Property would be under control of the enterprise ‘Lustica Development’. We would seek to find a partner for both sides at the international tender.
I expect the tender to be opened in July and the offers to be collected by September. Investment of capital would come up to Euro 100 Million during the first stage”, Minister of Tourism, Predrag Nenezic has said, adding that the government has also included the land which is owned by the local authorities in this offer, in order to obtain larger complex of land.
Nenezic explained that there would be a novelty in this tender, as an opportunity would be opened for the citizens to acquire (buy) up to 30 percent of shares in this company, while the amount would be limited by the citizen, in order to provide equal-opportunity situation.
“If it turns out that this model works well, we shall open other tender procedures in accordance with such model”, Nenezic concluded.
